Parental Consent, Rights and Options

SB 12 made significant additions and revisions to the Texas Education Code (“TEC”), some of which apply to open-enrollment charter schools like ACA and some of which do not apply to charter schools. However, ACA is committed to partnering with parents and seeks to honor that trust by providing this annual consent for your child to receive routine school-based physical and mental health-related services from qualified school staff, including nurses, counselors, and other school personnel, as needed. We are requesting your annual consent so that school personnel may respond in a timely manner to your student’s safety and wellness needs. Consent is valid for the entire school year unless you choose to revoke it in writing. Students without consent will default to declined consent.
ANNUAL CONSENT FORM
Without your consent, staff will be limited in the services they can provide to your child during the school day.
Consent for Counseling Services

- Positive character traits and personal skill group lessons
- Short-term individual counselor visits or check-ins
- Support during emotional distress or crisis
- Behavioral observations and problem-solving strategies
Consent for Health Services

- First aid for minor injuries, illness, and care to protect the immediate health and safety of the student (this includes band aids, ice packs, etc)
- Symptom evaluation, exclusion, and readmission for communicable diseases, etc.
- Vision, hearing, spinal, and Texas Risk Assessment for Type 2 Diabetes in Children screenings as mandated by the State. (allowable exemptions can be communicated to the nurse)
- Chronic health condition management and monitoring.
As a parent, you are the most important voice in your child’s education. Texas law recognizes that students do best when families are informed, involved, and respected. Parents are partners with educators, administrators, and school boards of trustees in their children’s education. Parents have specific rights outlined in the Texas Education Code including Chapter 26: Parental Rights and Responsibilities.
The form linked above provides information about many of the parental rights and options described in the Texas Education Code, including the right to refuse or remove your child from certain activities and instruction. It is not a complete description of all parental rights. Parents should review this form along with their district’s student handbook.
